Unfortunate Tour Bus Crash in San Bernardino Kills 8 and Injured Dozens

The hill heading down from Big Bear is treacherous to say the least.  It is wrapped with switchbacks and steep changes in elevation. On Sunday night, a tour bus that started in Tijuana was involved in an auto accident involving two other vehicles.  The tour bus hit two other vehicles and then rolled over.  While the investigation continues, authorities believe that the bus accident occurred because of faulty breaks.  The accident took place on Highway 38 in Mentone, San Bernardino.  There were many San Diego residents who passed away as a result of the accident.

What are Bus Accident Victims and Their Families Entitled to Recover?

When someone is injured or even killed as a result of someone else’s negligence, the law states that they are entitled to recover money for their damages.  These damages include past and future medical bills, past and future lost wages, and past and future pain and suffering.  The families of the victims who passed away are entitled to what’s called a wrongful death claim.  In a wrongful death claim, the surviving family members can hire a wrongful death lawyer to recover money for the loss of their loved one.

Personal Injury lawyer explains contingency fees

Personal injury attorneys usually work on a contingency fee basis.  A contingency fee is where the attorney fees are contingent upon recovering some type of monetary compensation for the client.  This allows people who may not be able to afford a lawyer on an hourly rate up front obtain legal representation.  The attorney fees are based on a percentage of the amount recovered.  If the lawyer does not recover any money for his client when on a contingency fee, the lawyer will not get paid any attorney fees.

Hiring a personal injury lawyer will get you more money for your injury case!

Many injured victims and their families think that they will get more money if they handle their claims directly with the insurance company.  People think that having to give up a percentage of their settlement for attorney fees will equal less money in their pocket.  This is simply not true.  Hiring an experienced injury attorney or car accident lawyer who specializes in insurance claims and has a track record of success will help you recover more money. Personal injury lawyers know the system and know how to fight the insurance companies.  If your car breaks down, you take the car to a mechanic.  If you get hurt, you go to the doctor.  Don’t fool yourself, if you get injured in a car accident, truck accident, bicycle accident, dog bite attack, or any other type of personal injury case, hire a personal injury attorney.  Insurance companies protect themselves with their lawyers and you should do the same.

Oceanside Car Accident End in Criminal Charges

A 21 year old drunk driver was being pursued by the police in Oceanside, California on November 16, 2012 and crashed his car while traveling at 80 m.p.h.  The car accident occured when the suspect hit a dip in the road on Mesa Blvd.  Unfortunately, there was a passenger in the vehicle and he passed away.  The driver was charged with gross vehicular manslaughter.  This last week, in Vista, California, he plead not guilty. If convicted, the defendant driver faces life in prison.

DUI Car Accidents Resulting in Wrongful Death

Unfortunately many car accidents that occur result in the wrongful death of innocent people.  Far too often drunk drivers cause accidents and kill other people.  The law is clear that if you have had a family member that has been the victim of a drunk driver, you may be entitled to seek damages against the drunk driver.  Because drunk driver is such an egregious act, you may be able to seek punitive damages against the defendant driver. Regardless of what happens at the criminal trial in the case, you may still have a civil case to pursue.

WHEN SHOULD YOU HIRE A PERSONAL INJURY ATTORNEY?

Personal injury lawyers focus on representing people who have suffered harm as a result of someone else’s negligence, carelessness, recklessness, and sometimes intentional conduct.  For example, if you were injured in a car accident because the at fault driver was texting and caused the car accident, you would be in a situation where you might need to hire a lawyer. There are countless different types of cases that personal injury attorneys take including car accidents, truck accidents, insurance claims, dog bites, brain injuries, back & neck injuries, defective products, and wrongful deaths to name a few.

Insurance Companies are NOT on your side

Insurance claims are very complicated. Insurance companies make money by selling insurance not by paying out money on injury claims.  A personal injury attorney can help you determine how much you have lost as a result of your injuries and how much you are entitled to recover.  The insurance company will NOT automatically pay for your losses even if they accept fault or liability for the event.  Thus, if you have been injured and will be dealing with an insurance company, hire a personal injury attorney.

Personal Injury Lawyers Can Get You More Money

When there is a problem with my plumbing, I hire a plumber.  If I am hurt, I go to the doctor.  Don’t try to handle your injury claim alone, hire a personal injury lawyer who is an expert.  A recent study performed by the insurance industry found that people who hired a personal injury attorney received 3x more money for their case.  This is because insurance attorneys know how to handle every aspect of your case and can file a lawsuit to fight for you.

TOP 4 MYTHS ABOUT SEAT BELTS

1) SEAT BELTS CAN TRAP YOU INSIDE A VEHICLE

It takes less than a second to take of a seat belt. Many people think of this situation in a burning vehicle or one submerged in water.  However, seat belts will help prevent you from being knocked  unconscious and you will have a better chance of surviving these types of situations.

2) SEAT BELTS ARE GOOD ON LONG TRIPS, BUT YOU DON’T NEED ON IF YOUR JUST DRIVING AROUND TOWN

More than half of all traffic deaths happen within 25 miles of home.  You do the math.  Don’t take a chance with you or your passengers when making short trips.
3) SOME PEOPLE ARE THROWN FROM A VEHICLE IN CAR ACCIDENTS AND WALK AWAY WITH NO INJURIES

Your chances of surviving a motor vehicle collision are five times better if, upon impact you are not thrown from the vehicle.
4) KIDS DON’T NEED TO BE FASTENED TIGHTLY IN THEIR SEATS

Car accidents are the NUMBER ONE preventable cause of death for children.  Double check your children’s seat belts and make sure their car seats/booster seats are securely fastened.

While most of these myths lack common sense that most of us use it is important to remember to always wear your seat belt.  Don’t take any chances and always buckle up.

Carlsbad Personal Injury Attorney Discusses The Dangers of Teen Driving

One of the leading causes of injury and death for teenagers in America are car accidents. Teen drivers are involved in more motor-vehicle collisions than any other age group in California. Some of the reasons behind the high rates of auto accidents among teens are:

  • Young Age/Lack of Driving Experience
  • Risky Driving Behaviors
  • Distractions

Our Carlsbad Car accident attorney recently  came across a study that found some alarming news about a major source of distractions for teen drivers.

A recent study by the AAA Foundation for Traffic Safety finds that teenage girls are twice as likely to use electronic devices behind the wheel as teenage boys. However, that doesn’t mean that teenage boys aren’t taking risks while driving. AAA says in a that “the leading cause of distraction for all teens was the use of electronic devices, which was seen in seven percent of the video clips analyzed.”

Not surprising, but cell phones, texting, personal grooming, and reaching for things were the most common distractions for teen drivers. This new study provides the best view we’ve had about how and when teens engage in distracted driving behaviors believed to contribute to making car crashes the leading cause of death for teenagers.”

AAA Foundation Senior Communications Manager Carol Ronis told ABC News that the study is important because car crashes are the leading cause of death for teenagers in the U.S. Additionally, teens have roughly four times as many car crashes as adults.

Carlsbad injury lawyer, Ryan Sargent, is a firm believer that education is the key to prevent teen driving auto accidents and deaths.  Teens will model their behavior after the people who are teaching them how to drive.  The laws regarding teen driving in San Diego and California have also become more strict to prevent more serious personal injury and death from car accident among teens. If you have a teenager, take the time to educate them on safe driving and practice with them.  If you are a teenager, stay off of your cell phone and pay attention to the road.

Our Carlsbad car accident lawyer focuses all of his practice on auto accident, personal injury, and wrongful death cases. Carlsbad Personal Injury Lawyer Discuses Child Safety Booster Seats in Car Accidents

New for 2012 is a change to the California Booster Seat Law.  As of January 1, 2012, parents, guardians, or drivers transporting children under 8 years old on a highway in a motor vehicle must secure that child in a restraint meeting federal motor vehicle safety standards.  The new safety seat laws have very severe fines including the possibility of child endangerment charges.

The reasoning behind the law is that seat belts are made for average adults and don’t fit children who are not at least 4’9” tall. Statistics show that using a booster seat reduces a child’s risk for injury in an auto accident by 59%.  So this new law begs the question, is Snookie required to be in a booster seat when she is in California? Snooki is only 4’9” and she would likely benefit from using a booster seat! However, lucky for her she is old enough that although it would be safer, she is not required to sit in a booster seat…
